Tampa DUI Lawyers Defend Truckers in .04 BAC for All Vehicles

According to Tampa DUI lawyers, driving 18 wheelers or the big rig trucks while intoxicated is not seen as often as driving the four wheeled regular every day vehicles because the blood alcohol content or a BAC level for any driver is .04 and for a regular vehicle driver it .08.

In addition to having a lower BAC level for drivers of large trucks, truck drivers could lose their CDL license – the license that allows them to drive a truck and thus make their living – they are also subject to losing their CDL license if they get a DUI in a regular vehicle which is usually a company or an employer law.

A low incident of fatal crashes involving intoxicated truckers shows us that such tough standards do work. So why aren’t regular motor vehicle drivers subject to similar laws?  Most truckers believe they should be and in fact, more than 70 percent of truckers who responded to a recent research project believe the BAC level for regular vehicle drivers should be lowered to .04.

Tampa criminal defense lawyers and many experts agree that the problem is not with the BAC level; the real issue is with the punishments for DUIs.  DUI punishments are not strong enough to deter repeat offenders; many drunk drivers are allowed to plea bargain down to reckless driving while others are all too happy to hand over their license knowing they will still drive because the chances of getting caught without a license are slim for a regular vehicle driver as opposed to the 18 wheeler truck driver.

According to many proponents of tougher DUI laws, including Mothers Against Drunk Drivers – MADD – states need to spend more time and money on things like sobriety checkpoints and going into the schools to teach new drivers the dangers of drinking while driving and the latest danger to young drivers: texting while driving.

Since Driver’s Education has been dropped from nearly all public school curriculum, students are learning the hard way about the dangers of drinking and driving instead of watching horror-style films that would have an impact on their choice to drink and drive.
